Instagram Account Disputes With an Agency

When an agency holds your Instagram, the contract and the registered email decide the outcome — not goodwill. Here is how to get the account back cleanly, or fall back to a legal route.

Agencies often create or take over a client account "to make setup easier", which quietly puts them in control of the credentials and the registered email. If the relationship sours, the agency is holding the asset. The cleanest recovery is a cooperative handover backed by your contract; if that fails, your leverage is documentation and, ultimately, the law.

Getting your account back from an agency

Stage 1 · Stabilize

Stop the situation getting worse

  1. Document the current state: who has the credentials, what email is on the account, and any partner or portfolio access.
You are building a record before access can be cut off.
  2. If you still have any access at all, secure it and note what you can and cannot do.
Stage 2 · Diagnose

Find the contract and the email

  1. Locate the agreement that defines who owns the account and what happens at the end of the engagement.
For businesses, the contract is what a court will weigh first.
  2. Confirm the original registered email — if it is one you control, your position is much stronger.
Stage 3 · Reclaim

Request the handover

  1. Send a written request for the agency to change the email and password to ones you control and to remove any partner access.
Where: Cite the relevant contract clause.
  2. If they refuse and you control the original email, use Instagram login help and identity verification to reset access yourself.
Where: instagram.com/accounts/login → Get help logging in
  3. If they hold everything and will not cooperate, take legal advice — only a court can compel a handover Instagram will not.
Stage 4 · Harden

Never be here again

  1. Re-create the account under a business-owned email and add the agency as a partner by their Business Portfolio ID instead of giving them the login.
Where: Meta Business Suite → Partners

Frequently asked questions

Not automatically. Account creation is one factor, but for a business account a court weighs the contract, who funded and used it, and how it was branded. Without a clear agreement, creation and credential control give the agency a strong practical hold.

Delvia

Access issues are easier to prevent when roles, owners, and responsibilities are recorded clearly

Most access problems trace back to the same gap — no clear record of who has access, what role they hold, and what should happen when that changes. Delvia helps you keep that record so problems are visible before they become incidents.

Delvia is free on iPhone and Android. Keep a clear record of who has access to your accounts — and what to do when that changes — wherever you are.
